By using the website you agree to following terms and conditions in the agreement. Please note that in an event of change in this agreement, we will publish it online on the website without prior intimation. We request you to review the site periodically for such changes. This is a legal and binding document between you and AdsOnDiscount. The website (http://www.adsondiscount.com) is fully owned by AdsOnDiscount a partnership firm registered under The Partnerships Act 1956.

DECLARATION

The information provided on this website includes, but is not limited to, the services provided by AdsOnDiscount and does not render any advice, certifications, guarantees or warranties on the Content (as defined below) relating to the services, which AdsOnDiscount makes available on this Site. AdsOnDiscount will be referred to as “AdsOnDiscount.com” in the rest of the document.

DISCLAIMER

AdsOnDiscount.com is not liable for any inaccurate / misleading information/ advertisement given by the Advertiser/User. AdsOnDiscount.com is not responsible for the consequences of any actions taken based on the information provided on the website. Advertisement placed through AdsOnDiscount.com is available only to individuals who confirm all the valid and legal requirements to enter into a valid contract enforceable under the law.

TERMS OF USE

AdsOnDiscount.com has sole discretion & reserves the right to modify the Terms & Conditions at any time and without prior notice to its Advertiser/User. By booking ads through AdsOnDiscount.com after the changes / modifications have been posted it is automatically deemed that you have checked/reviewed & agree to accept those changes / modifications.

CONTENT

By using or accessing the website, the Advertiser/User states that the contents of the advertisement given by them are true and correct and is not misleading & is in compliance with the laws in India. The Advertiser stands by the content of the said advertisement and indemnifies the Newspaper/ AdsOnDiscount.com of any action legal/civil that may follow because of the publication of the said advertisement. Under no circumstances will AdsOnDiscount.com be liable for any loss to the advertiser for any error or omission on part of the publication.

BUSINESS ETHICS

All the Ads are accepted in good faith and AdsOnDiscount.com will not be responsible whatsoever regarding the bonafides of the Advertiser/User, nor will any dialogue or correspondence be entertained into regarding any advertisement published.

INDEMNITY

The Advertiser/User indemnifies AdsOnDiscount.com for any action or claim by any third party resulting from any advertisement released by the Advertiser/User or his/her agents or agency.

LIMITATION OF LIABILTY

AdsOnDiscount.com will not be liable under any circumstances for any loss to the advertiser for any error or omission. All ads given to AdsOnDiscount.com by the Advertiser/User to be published will be assumed to be approved & confirmed by the Advertiser/User.

CANCELLATION POLICY

Cancellations of a booked ad will be entertained as per the publication deadline of booking & cancellation policy. AdsOnDiscount.com will co-operate & will make an effort to try & cancel an ad if the reasons stated by the Advertiser/User are based on certain unforeseen circumstances but does not guarantee cancellation of an ad once booked. Cancellations and alterations will be accepted only in writing given to AdsOnDiscount.com with at least 7 days prior notice and will be executed under our cancellation policy.

REJECTIONS & ALTERATIONS OF ADS BOOKED

• There are a few banned words which cannot be used in an advertisement. These have been listed down by the publications. We have listed them too on the website & Advertiser’s/User’s are advised to go through the same & avoid the use of such words. If a publication objects to certain words/images used by the Advertiser/User or are out of the publication’s purview the ad can be declined. In such a scenario AdsOnDiscount.com will rectify the ad offline on telephonic support to the Advertiser/User & release the ad or the amount paid can be refunded to the Advertiser/User as per the Refund Policy.
• Alterations/Modifications will be accepted only in writing prior to sending release instructions to publications by AdsOnDiscount.com with extra costs if applicable. Once the release instructions have been placed to the publication no request for change in the ad material would be accepted.

LEAD TIME

The user agrees to the stipulated 48 hours processing period for all the advertisements to be published. In a situation where user selects multi publication/multi editions, the Publication will reserve the right to re-schedule the advertisement print dates subject to availability of space & dates with the publication.

PUBLICATION RULES

• All ads are subject to approvals from the respective publication with whom it has been booked.
• com reserves the right on behalf of the publication to decline or reschedule any advertisement/listing notwithstanding earlier acceptance by us or even if payment for the advertisement has been made.
• If the advertiser, for eg. has paid for 5 lines & if the publication sets the ad in 6 lines (typical during translations) AdsOnDiscount.com reserves the right to reduce the font size or shorten the words to fit the ad accordingly it has been paid for. Yet if it doesn’t fit as per the lines paid for, AdsOnDiscount.com will inform the Advertiser/User of the same & the Advertiser/User can pay the extra sum of monies through cash or AdsOnDiscount.com will try to cancel the ad. If the ad is cancelled the Advertiser/User can claim refund as per our Refund Policy.
• All rates quoted on the website are as per the publication rate card which is introduced/revised from time to time. Any change in rates will be updated on the website regularly. Incase an ad has been booked & paid for by an Advertiser/user as per the prevailing rates & the publication revises their rates at the time of releasing the ad the User/Advertiser will have to pay the difference amount of the booked ad before its release date.
• com will not be responsible if the publication rejects, makes a request for alteration of the words in an ad or asks for a re-schedule of a booked ad due to unavailability of space.
• In case of translations of ads in other languages executed by a publication the ad will not be sent for approval to the advertiser before being published.
• The placement of the ad on page/page nos. is strictly as per the discretion of the publication. AdsOnDiscount.com will not commit special pg. positions/guaranteed pg. positions.
• The enhancement of Lineage ads will appear a little different when published than it appears on the computer screen.
• In the case when an Advertiser/User chooses a discount package with multiple ads on different days & within a stipulated time as the publication rules, the Advertiser/User will have to pre-select all the dates/days they would like to publish the ads. Dates once selected cannot be altered on the website. The Advertiser/user will have to notify AdsODiscount.com 7 days in advance for alteration of dates required. AdsOnDiscount.com will not be held responsible for any alteration in dates once the ads are booked online.

10.)In case different artworks are to be published on different days/dates in discount package of multiple ads the Advertiser/user will have to co-ordinate on artwork finalization with AdsOnDiscount.com on telecon as the website cannot comply the same.

11.) AdsOnDiscount.com is an agent which is instrumental in releasing advertisements in publications on behalf of the Advertiser/User.

USE & CONDUCT

1.1 AdsOnDiscount.com service is made available for lawful purposes only. This includes without limitation any unauthorized use of material protected by patent, copyright, trademark or other intellectual property right, material that is obscene, defamatory or libelous, constitutes an illegal threat, or violates rights of privacy or publicity, or violates export control laws. The user may use the information on our site only to the extent necessary to facilitate AdsOnDiscount.com related transactions.

The Advertiser/User shall not use a false e-mail address, will not create multiple email addresses, impersonate any person or entity, or otherwise mislead as to the origin of the Contents. However, the Advertiser/User acknowledge that AdsOnDiscount.com does not pre-screen the Content, but that AdsOnDiscount.com and its designees shall have the right (but not the obligation) in their sole discretion to accept, refuse, remove any Contents that are used in the Advertisement to be published.

1.2 The Advertiser/User understands that all Contents, provided in the Advertisement, are the sole responsibility of the person from which such Content originated. This means that the Advertiser/User, and not AdsOnDiscount.com, are entirely responsible for all Content that have been provided with in order to upload & made available via the website.

1.3The Advertiser/User expressly agrees not to use the Website to: (i) harm any user in any manner either directly or indirectly; (ii) forge headers or otherwise manipulate identifiers in order to disguise the origin of any Contents transmitted through the website; (iii) upload or transmit any material that is deemed derogatory with respect to the name, services or Contents relating to or provided by AdsOnDisount.com; (iv) intentionally or unintentionally violate any applicable local, state, national or international laws;

1.4 The Advertiser/User expressly represent and warrant that: (i) they are capable to use this Website in accordance with all terms and conditions herein in relation to the access and use of this Site and the services provided therein; and (ii) all information supplied by them in any correspondences or any other documentation to AdsOnDisocunt.com is true, complete and accurate.

REFUSAL OF SERVICE

AdsOnDiscount.com, in its sole discretion, determines that a violation of the Terms & Conditions has occurred, AdsOnDiscount.com may pursue any of its legal remedies, including but not limited to the immediate rejection of any offending material, cancellation of the user’s account and/or the exclusion of any person(s) who may have violated any Terms & Conditions. AdsOnDiscount.com will cooperate with any investigation conducted by any Central, State, or local body or any court or tribunal legitimately exercising its rights. Such cooperation may be without notice to the user. If AdsOnDiscount.com believes in its sole discretion that any ad that may create liability for AdsOnDiscount.com, AdsOnDiscount.com may take any actions that it believes are prudent or necessary to minimize or eliminate its potential liability, including but not limited to, the release of User information. In sum, AdsOnDiscount.com reserves the right to refuse service to anyone at any time, and to remove any user & their advertisements for any reason, and without notice.

APPICABLE TAXES & COSTS

Advertiser/User understands and agrees that they are liable to pay all applicable taxes and all costs that are incurred in publishing ads by using AdsOnDiscount.com service. We may also, in our sole discretion, make changes to the costs associated with the Service.

WARRANTY OF SERVICE

AdsOnDiscount.com makes NO warranty that the services obtained from AdsOnDiscount.com will meet Advertiser/User’s requirements, that the service will be uninterrupted, timely or error free; nor does AdsOnDiscount.com make any warranty as to the results that may be obtained from the use of the service or as to the accuracy or reliability of any information obtained from the service.

USER DETAILS

AdsOnDiscount.com reserves the right over the material or User Data displayed on the user listings. User Data is restricted to identify a specific individual such as their name, address, phone number, etc. The Advertiser/User shall not create any fake identity or impersonate another person & shall fill in accurate information as required to use the Website AdsOnDiscount.com

GOVERNING LAW & ARBITRTION

All legal proceedings shall be subject to the jurisdiction of the courts in Mumbai, India and shall be governed by and construed in accordance with the laws of India and the Advertiser/User agrees to resolve the disputes under the Arbitration and Conciliation Act 1996. The venue for such arbitration shall be at Mumbai, India

REFUND POLICY

If an advertisement insertion is missed due to certain reasons which include some technical glitch at the publication’s end or non-receipt of payments from Advertiser/user on time, incorrect date selection wherein the supplement/publication isn’t scheduled or cancellation of the issue or any other last minute changes made by the Publication AdsOnDiscount.com will re-schedule the advertisement for another date. If the Advertiser/User doesn’t want the ad to be published on an alternate date AdsOnDiscount.com will refund the monies after deducting service charges. Ad refunds are processed in the same mode in which we receive the payment. In case of refund of payment made through cash collection, refund will be expedited in an Electronic transfer or Cheque mode. Refunds are processed within 10 business days.

PROOF OF PUBLISHING

AdsOnDiscount.com will confirm the release of advertisement but cannot issue tear-sheet of advertisements to the Advertiser/User. For main city editions e-paper copies can be sent by email but for other Tier-II or Tier III towns the Advertiser/User will have to procure the copies from their local vendors.

DISCOUNT

AdsOnDiscount.com will offer discounts as promised. It is upto the discretion of AdsOnDiscount.com to change/alter percentage/slab discounts offered from time to time.
